Right of rescission

If the customer is a consumer, he has the right according to § 5e KSchG to withdraw within thirty days from date of receipt delivery. The resignation has no justification and must be declared in writing. Date of mailing is relevant as the deadline. The declaration of withdrawal must be sent to the following address:

The right of withdrawal shall not expire by opening the package. If the goods were used and/or damaged, the customer pays a reasonable fee for the use and/or bear adequate compensation for damages. A return must be made with sufficiently ensured and franked parcel, incl. enclosed invoice.
From the amount customer paid according the invoice in advance, designated shipping charges, transfer costs will be deduced and after receipt of the goods from the customer, remaining amount will be transferred to customer.

The right of withdrawal does not exist for the goods sent as a file and electronically. In addition, there is no right of withdrawal for the delivery of audio and video recordings or software, if the delivered data have been unsealed or activated by the consumer.

The right of withdrawal shall further not apply to goods that are produced according to customer specifications or clearly tailored to personal needs.
